How does this work exactly?
You can just switch like that from Labour to the maori party unelected?
Wouldn't you be required to remain as an independent MP until the next election?

Might be because she hasn't technically resigned from Labour... so she would have to resign or be expelled from labour for the waka jumping legislation to be invoked. I can see her being expelled fairly quickly if she doesn't officially resign from labour
Quote:That same day, Speaker of the House Adrian Rurawhe confirmed that Whaitiri would serve the remainder of her 2020–2023 term as an independent member of Parliament under standing order 35.5, which avoids invoking the waka-jumping provisions of the Electoral (Integrity) Amendment Act 2018. Rurawhe's decision not to invoke the waka-jumping law was criticised by National Party MPs Michael Woodhouse, Chris Bishop, and ACT Party leader David Seymour.[45] On 4 May, Rurawhe clarified that he had not received from Whaitiri a letter of resignation from Labour, despite her public statements.[46] Therefore she remains a Labour MP under electoral legislation, but is an independent MP for parliamentary purposes under standing orders.[47]

Leave it to the electorate. There is no indication they are likely to change party allegiance after decades of being a solid Labour seat. Especially for someone more interested in her career than in helping her voting base who are enduring all kinds of shit right now.
They're not stupid.

https://en.wikipedia.org/wiki/Meka_Whaitiri From what I read, the speaker of the house could have invoked the Waka jumping legislation, but didn't.
I dont know how that even works if she still is technically a member of Labour.

And now we have Green MP jumping ship as well. As a list MP she should be kicked from Parliament and the next person on the Green list. Whaitiri at least has some legitimacy as a elected MP with an electorate.

I think the investigation should have been allowed to run its course. Her jumping kind of short circuited that process, which I suspect was her intention.
I think the system will remove her as it rolls on.
Interesting isn't it, the way the system deals to politicians who get just a little too big for their boots. Plenty of examples in the not so distant past to illustrate the point.

That was quite an answer but didn't really answer the question.

This one didn't ask the question though, nor needed the answer.

That's more about complying with rules of engagement and resisting acting on whatever the f**k you think should be happening.

As a list MP once she leaves her party she should no longer be in Parliament. She should no longer be an MP. She does not have any mandate to remain.
